Terms of Rental

1. Who may rent and drive

• Drivers of a car must be at least 21 years old. Riders of a motorbike or scooter must be at least 18. Every driver must have held a full licence for at least one year.
• Every driver must show, at pick-up, a passport, a full driving licence valid for the class of vehicle, and an International Driving Permit (IDP) or Thai licence where the home licence is not in English. For a motorbike the licence and IDP must cover motorcycles. Thai law requires this, and travel insurance is routinely refused without it.
• Every person who will drive must be named on the rental agreement and show the same documents. Additional drivers from your own party are free. Anyone not named on the agreement is not insured to drive.
• We take a copy of your passport and licence. We never hold your passport as a deposit.

2. Booking, prices and payment

• Prices are in Thai Baht per rental day of 24 hours, with unlimited mileage, first-class comprehensive insurance on cars and compulsory plus third-party insurance on motorbikes, a helmet and lock with every bike, and 24-hour roadside assistance. Any other currency shown is an estimate; your card issuer sets the rate you are charged.
• Payment is made in full, upfront, online when you book, through Stripe. We do not see or store your card number. No cash deposit and no card pre-authorisation is taken at pick-up, and nothing is charged to your card afterwards except a payment you make yourself, for example for extra days.
• Extras are charged as shown at the time of booking: a child seat at a flat ฿200 per rental, and a driver at ฿500 per day on cars. Extra helmets and phone holders are free.
• Your confirmation email is your booking record and your receipt. A tax invoice is available on request.
• We may decline or cancel a booking, with a full refund, if the documents in section 1 cannot be shown, if the vehicle booked is unsuitable for the trip described, or if we have reason to believe the vehicle will be misused.

3. Cancellation, changes and refunds

• Cancel free of charge up to 24 hours before the pick-up time. We refund the full amount to the card you paid with.
• Cancel less than 24 hours before pick-up, or do not appear, and we charge one day's rental and refund the rest.
• Date changes made more than 24 hours before pick-up are free. If the new dates cost more we send a payment link for the difference; if they cost less we refund it.
• Ending a rental early does not entitle you to a refund of unused days, unless we agreed otherwise in writing.
• Refunds are processed within one business day. Your bank then takes its own time, typically 5 to 10 business days for an international card.

4. Pick-up and return

• We deliver and collect anywhere in Chiang Mai city free of charge, including the airport. Our normal hours are 08:00 to 20:00, but we are flexible: tell us your flight or your plans when you book and an earlier or later time is almost always fine. Returns in another province are by arrangement, with any relocation fee quoted before you book.
• At pick-up we inspect the vehicle together and photograph its condition, fuel level and mileage. Tell us about anything you notice before you drive away; it is recorded on the agreement.
• Fuel is full to full. We hand the vehicle over full and ask for it back full. If it comes back short we refuel it for a flat ฿100 for a car or ฿10 for a motorbike, fuel included.
• Return the vehicle at the agreed time and place. If you need longer, message us before the return time: a later time agreed with us costs nothing extra on the same day. Extra days are paid when you extend: we send you a payment link for the additional days at the normal daily rate and you pay it as a separate charge. We never place a hold on your card and never charge it without you. A return that is more than 60 minutes late without our agreement is charged as a further rental day, because the next customer is usually waiting.
• Return the vehicle in the condition you received it, allowing for ordinary use. Excessive dirt, sand, smoke smell or stains are cleaned at cost.

5. Using the vehicle

You agree that the vehicle will be used only:

• by drivers named on the rental agreement, holding the documents in section 1;
• within Thailand. Vehicles may not be taken across an international border;
• on public roads. Not on unsealed tracks, off road, on beaches or through flood water;
• lawfully. Not while under the influence of alcohol or drugs, not for racing, towing, driving instruction, carrying paying passengers or goods for hire, or any illegal purpose;
• within the vehicle's capacity for people and luggage, with seat belts worn, and with a helmet worn by every rider and passenger on a motorbike, as Thai law requires;
• with the vehicle locked and the keys kept with you whenever it is left.

Smoking in the vehicle is not permitted. Pets are welcome by prior agreement.

Our route guides say which vehicles suit each road. A 125cc scooter is not suitable for the mountain routes to Doi Inthanon, Doi Ang Khang, Pai or Mae Hong Son, and we may refuse to release a vehicle for a trip it is not suited to.

6. Insurance, damage and your liability

• Cars carry first-class comprehensive insurance and Thailand's compulsory motor insurance, at no extra cost and with no cheaper tier. It covers damage to the vehicle, third-party injury and third-party property.
• You are liable for the insurance excess stated on your rental agreement for each incident of damage to, or loss of, the vehicle. We point the figure out at pick-up. Where damage is caused by an identified third party who is found at fault, the excess is waived once their insurer accepts liability.
• Motorbikes and scooters carry compulsory insurance and third-party cover. Damage to the bike itself, and its loss, is charged at the cost of repair or replacement as assessed by the dealer, up to the value of the bike, unless the rental agreement states otherwise.
• The insurance does not cover, and you are fully liable for, loss or damage arising from any breach of section 5, from an unlicensed or unnamed driver, from driving under the influence, from riding without a helmet, from off-road or flood driving, from misfuelling, and for lost keys, documents or number plates, and for damage to tyres, wheels, the underside and the interior caused by misuse.
• Personal belongings left in the vehicle are not insured by us.
• Where you are liable, we invoice you after assessment with the repairer's quotation and the photographs from pick-up and return. We do not take an open-ended card hold to secure it.

7. Accidents, breakdowns and theft

• In an accident, make sure everyone is safe, then call us before moving the vehicle or agreeing anything with anyone. We answer 24 hours a day in English. Call 1669 for an ambulance and 191 for the police. Photograph everything.
• In Thailand the insurer's assessor attends the scene and determines fault. Do not admit fault, pay money or sign anything you cannot read. Failing to report an accident to us on the day, or settling privately, can void the insurance and leave you liable for the full cost.
• Roadside assistance is included throughout northern Thailand. If the vehicle cannot be repaired where it stands we bring a replacement of the same or a higher class.
• If the vehicle is stolen, report it to the police immediately, obtain the police report, and tell us the same day.

8. Traffic fines, tolls and parking

You are responsible for every traffic fine, parking charge and toll incurred while the vehicle is in your care, including any received by post after the rental ends. Where a fine is sent to us as the registered keeper, we pay it and charge you the amount of the fine, nothing more, and send you a copy of the notice. Thai police may also issue fines directly to the driver at the roadside.

9. What you can expect from us

• The vehicle class you booked, or a higher one, clean, serviced, legally insured and with a full tank. If we have to substitute a vehicle we tell you before pick-up, and it will never be smaller or less capable than what you booked.
• If we cannot supply a suitable vehicle at all, you receive a full refund. Our liability for anything arising from a booking is limited to the amount you paid for it, except where Thai law does not allow that limit, including for death or personal injury caused by our negligence.
• We are not liable for delays or loss caused by weather, road closures, official action or other events outside our control, though we will always try to help you around them.

10. Personal data

We collect and use your personal data as described in our Privacy Policy, in accordance with Thailand's Personal Data Protection Act B.E. 2562 (2019).

11. General

• These terms are governed by the law of Thailand. Disputes are subject to the courts of Chiang Mai, without prejudice to any right you have as a consumer to bring a claim where you live.
• These terms are published in English and Thai. If the two versions differ, the Thai version prevails.
• Nothing in these terms removes a right you have under the Consumer Protection Act B.E. 2522 or the Unfair Contract Terms Act B.E. 2540 that cannot be excluded.
• We may update these terms. The version in force for your rental is the one published when you booked.
